THE REGULATION OF THE DIRECTOR GENERAL OF FOREIGN TRADE ON TECHNICAL PROCEDURES FOR ENDORSEMENT BY THE FORESTRY INDUSTRY REVITALIZATION BOARD (BRIK).

Article 1

Forestry industry products regulated in this regulation are those subsumed into HS.4407, HS.4408, HS.4409, HS.4410, HS.4411, HS.4412, HS.4413, HS.4415, HS.4418, Ex. HS.4421.90.99.00 (especially for timber paving block) and HS.9406.00.92.00.

Article 2

Approved Exporters of Forestry Industry Products (ETPIK) planning to export the forestry-industry products as intended in paragraph (1) must secure prior Endorsement Ratification Document from the Forestry Industry Product Revitalization Board (BRIK).

Article 3

In order to obtain the Endorsement Ratification Document, ETPIK must submit application to BRIK by enclosing:

Description of goods and tariff headings as well as technical criteria submitted in the document of Export Plan refer to Attachments I and II to Regulation of the Minister of Trade No. 09/M-DAG/PER/2/2007 concerning provisions on the export of forestry industry products.

Article 5

(1) BRIK examines documents conveyed by applicants.

(2) The examination as intended in paragraph (1) covers technical criteria for products, which would be exported, output rate as well as legality of raw materials.

Article 6

(1) BRIK is obliged to issue or deny application for endorsement in writing in not later than 3 (three) days as from the date of receipt of the application.

(2) In the case of the result examination as intended in paragraph (1) being suitable to the provisions in force, BRIK issues Endorsement Ratification Document.

(3) The validity period of the endorsement ratification document is 30 (thirty) days as from the date of issuance.

Article 7

Every Endorsement Ratification Document is only usable as customs complementary document required for registration of one number of Export Declaration (PEB) or Customs Declaration of Single Administrative Documents (PP SAD) for Customs and Excise Service Offices already applying it.

Article 8

Copy of Export Declaration or PP SAD and copy of Surveyor Report (LS), copy of bill or Loading (B/L), copy of Invoice and copy of packing list (P/L) must be conveyed by ETPIK to BRIK in not later than 14 (fourteen) days after securing loading approval.

Article 9

(1) BRIK is obliged to convey data about Endorsement Ratification Document electronically to the Director General of Foreign Trade, Ministry of Trade and surveyors in not later than one day after the date of issuance of the document.

(2) BRIK is obliged to convey report on results of the implementation of endorsement to the Director General of Foreign Trade, Ministry of Trade with a copy made available to with a copy made available to the Director General of Agro and Chemical Industries, Ministry of Industry and Director General of Forestry Production Development, Ministry of Forestry in the form of hard copy and electronic data by using the format as contained in Attachment I to this regulation in not later than the 15th of the ensuing month.

(3) BRIK is obliged to convey report on the realization of the export of ETPIK to the Director General of Foreign Trade, Ministry of Trade with a copy made available to with a copy made available to the Director General of Agro and Chemical Industries, Ministry of Industry and Director General of Forestry Production Development, Ministry of Forestry in the form of hard copy and electronic data by using the formats as contained in Attachment II to this regulation in not later than the 15th of the ensuing month.

Article 10

Violation of the provision as intended in Article 9 is subjected to sanction in the form of written warning.

Article 11

With the enforcement of this regulation, Regulation of the Director General of Foreign Trade No. 01/DAGLU/PER/3/2006 on Technical Procedures for Endorsement by the Forestry Industry Revitalization Board (BRIK) is revoked and declared null and void.

The regulation starts to come into force 2 (two) months as from the date of stipulation.
